Artist & Vendor Terms and Conditions

Welcome to Viva La Burma! We are honored to have you join our community. These Terms govern your use of our platform as an Artist or Vendor. By uploading your artwork, you agree to these Terms.
1. The Agreement
This document forms a legally binding agreement between you and Viva La Burma ("the Company," "we," "us"). Our platform allows you to upload your original artwork ("Designs") to be sold on various products ("Products") to customers. We handle production, sales, and shipping.
2. Your Intellectual Property Rights
You Retain Ownership
You retain full ownership, copyright, and all intellectual property rights to your original Designs. We do not claim any ownership rights over your artwork.
License to Viva La Burma
To operate our service, you grant Viva La Burma a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify (for formatting purposes), and distribute your Designs for the purpose of producing, promoting, and selling Products featuring your artwork.
What this means: This license allows us to place your Design on a t-shirt, show it on our website, market it on social media, and sell it to a customer — strictly for operating the Viva La Burma platform.
Termination of License
You can terminate the license at any time by removing your Designs from our platform. We will cease selling Products with the removed Designs, but may fulfill orders placed before removal.
3. Your Responsibilities as an Artist
Originality and Rights
You represent and warrant that you are the sole creator of your Designs and that they do not infringe upon the intellectual property rights of any third party.
Prohibited Content
You may not upload content that is unlawful, defamatory, obscene, hateful, or discriminatory. We reserve the right to remove any Design without notice.
Account Information
You agree to provide accurate information and are responsible for maintaining the security of your account password.
4. Pricing and Payments

Payouts
We pay out accumulated earnings on a monthly basis. Minimum payout threshold is 500 THB. Payouts are made via your specified method.
Taxes
You are solely responsible for paying any and all taxes on the income you earn through Viva La Burma in your jurisdiction.
5. Viva La Burma's Role
Production
Quality control, packaging, and shipping to customers.
Platform
Maintaining website, processing payments, and managing sales.
Support
Handling all customer inquiries, returns, and exchanges.
Marketing
Promoting the platform and featuring designs to drive sales.
Additional Clauses
6. Termination
Either party can terminate at any time. We may suspend accounts for breach of Terms, especially IP infringement.
7. Liability
Platform provided "as is." Viva La Burma is not liable for indirect or consequential damages.
8. Governing Law
Governed by the laws of Thailand. Disputes are subject to the exclusive jurisdiction of courts in Chiang Mai, Thailand.
9. Changes
We may update these Terms and will notify you of significant changes. Continued use constitutes acceptance.
